Terms of Use

Mercilia is operated by Hive Technology Consultancy Co., a Kuwaiti Single Person Company, Commercial Registration No. 473317, Commercial Licence No. 2023/4678 (“Hive”, “we”, “us”, or “our”).

These Terms of Use (“Terms”) govern your access to and use of Mercilia, a wellness application (the “Application” or “App”). By downloading, installing, or using Mercilia, you (“User,” “you,” or “your”) agree to be legally bound by these Terms. If you do not agree, you must not install or use the Application.

These Terms apply to Mercilia on Android and iOS. An app version released before these Terms, such as the current iOS app, may still show an earlier version of our terms on its own screen. These Terms, as published on our website, are the current version and govern your use of Mercilia.

1. Eligibility

You must be at least 13 years of age to use Mercilia. If under 18, you must have parental or guardian consent. Mercilia is not directed toward users under the age of 13.

2. No Accounts

Mercilia has no user accounts. Purchases belong to the Google Play or Apple account used to make them. To restore Premium on another device, sign in to the store with that account and use Restore Purchases in the App.

3. Subscriptions & Payments

  • Premium is available as a monthly or yearly auto-renewing subscription, and as a one-time Lifetime purchase. Before you buy, the store shows the price, the billing period and any offer available to you.
  • Payments are processed by Google (Google Play) or Apple (App Store). We don’t receive or store your card number or other payment credentials.
  • Subscriptions renew automatically until you cancel:
    • Google Play: cancel at any time in Google Play → Payments & subscriptions → Subscriptions. Premium continues until the end of the period you’ve paid for.
    • App Store: cancel in your Apple Account settings at least 24 hours before the end of the current period.
  • If you’re offered a free trial or an introductory price, the store shows its length and the price that follows before you confirm. Unless you cancel before the trial or introductory period ends, the subscription continues at the price shown.
  • Changing plan in the Android app, from version 1.28.0: switching between monthly and yearly replaces your subscription straight away. Google Play credits the time you haven’t used by moving your next billing date. On the App Store, Apple handles plan changes.
  • Lifetime is a one-time purchase with no renewals. Buying it doesn’t cancel an existing subscription; cancel that separately in your store.
  • Resetting app data or uninstalling the App deletes data on your device only. Neither cancels a subscription.
  • Refunds:
    • Google Play: Google may give refunds under Google Play’s refund policies, and you can request a refund through Google Play. You can also contact us at contact@mercilia.app. We can refund Google Play orders, and we consider refund requests case by case, subject to your rights under applicable consumer law.
    • App Store: request refunds from Apple at reportaproblem.apple.com. Apple decides them under its policies.

4. Wellness Disclaimer

Mercilia provides yoga, breathwork, and ritual guidance for general wellness. It is not medical advice and should not replace professional consultation. Always consult a qualified healthcare provider before starting any new wellness or fitness practice. Use of the Application is voluntary and at your own risk.

5. Intellectual Property

The App and its content belong to us or our licensors. That content includes the text, audio and images, the selection and arrangement of poses into Mercilia’s rituals and flows, and the names Mercilia uses for them. We grant you a limited, personal, non-transferable, non-exclusive and revocable licence to use the App.

Without our express written permission, you may not:

  • copy or record the App’s content in order to publish, share, sell or distribute it, including its rituals and flows as arranged in the App;
  • extract or reverse-engineer any part of the App, except where the law allows it; or
  • present classes, recordings or products as Mercilia’s, or use the names “Mercilia” or “Ascension” in a way that suggests something comes from us or is endorsed by us.

“Ascension” is the name Mercilia uses for a style of practice and for rituals in the App. These Terms don’t claim ownership of yoga poses, breathing techniques or movement methods themselves. You’re free to practise and teach yoga. What needs our permission is reusing Mercilia’s own content and presentation.

To ask for permission to reuse Mercilia content, email contact@mercilia.app. Permission is valid only if we give it in writing.

6. User Obligations

  • Use Mercilia only for lawful and personal purposes.
  • Do not upload harmful code, disrupt servers, or exploit vulnerabilities.
  • Do not misrepresent affiliation with Hive.
  • Do not engage in unauthorized sharing, resale, or scraping of app content.

7. Indemnification

You agree to indemnify, defend, and hold harmless Hive, its affiliates, and licensors from any claims, losses, or expenses arising from your misuse of Mercilia or violation of these Terms.

8. Termination

Hive may suspend or terminate your access immediately for breach of these Terms or suspected fraud. You may stop using the Application at any time by uninstalling it. To stop paying, cancel your subscription in Google Play or in your Apple Account settings. Clauses concerning Intellectual Property, Limitation of Liability, and Governing Law survive termination.

9. No Warranty

Mercilia is provided on an “as is” and “as available” basis. Hive disclaims all express or implied warranties, including fitness for a particular purpose and uninterrupted operation. Technical issues may occur, and Hive shall not be held liable for any resulting disruption or loss.

10. Limitation of Liability

To the fullest extent permitted by law, Hive and its affiliates shall not be liable for indirect, incidental, consequential, or punitive damages. Total cumulative liability shall not exceed the amount you paid for Mercilia in the preceding twelve (12) months. Nothing herein limits liability for death or injury caused by negligence where such limitation is prohibited by law.

11. Governing Law

These Terms are governed by the laws of the State of Kuwait. Any dispute shall be resolved exclusively in the courts of Kuwait, without prejudice to mandatory consumer rights under applicable law.

12. Updates to These Terms

Hive may revise these Terms periodically. Updates will be posted at https://mercilia.app/terms, and continued use of Mercilia constitutes acceptance of the updated Terms.
